Rumor always has been that Allis stayed away from making a Big round Baler because of all of the lawsuits from the Small round Baler. You would think that AC would have been a pioneer of the big rounds, but they decided to stay out of the game.

This is, of course, as a lawsuit filed in St. Clair County court alleges, the fault of John Deere and Home Depot. (Ann Knef, “Home Depot, John Deere named in child’s lawn mower accident suit”, Madison County Record, Jun. 25). The suit alleges that “The subject lawn mower is defectively designed in that it should have been designed in a manner that does not allow for the mower to be operated with its blades moving in reverse.” In other words, because someone might not follow instructions, the rest of us should be deprived of a feature we might want to use. Too, the suit implausibly claims a failure to warn; perhaps the warning label should have specified “Your three-year-old son Conor” rather than just “children.” |

I noticed that my neighbor's JD mower shuts off the blades when the driver backs up. Glad my zero turn doesn't do that.

Really sad when someone makes a mistake but does not or will not accept fault blaming a machine or a control function and not their own bad judgement. Also bad when a jury awards such bad examples of hysterics based lawsuit to the plaintiff KNOWING and seeing the fault lies with that person and not the machine but the days of $$$$ in courts has been rolling up for a long time, should never have made it to or been allowed to go to a court.

New Idea had thousands of cases on corn pickers against them. One of the reasons they dropped them from their line.

Some of us automatically know that we don't have to reach under a running lawnmower to know that doing so is a sure fire way to lose a body part. (common sense) In the case of some people though, common sense is a flower that doesn't grow in their garden...

The biggest problem with these frivolous lawsuits is the slimy lawyers who file these suits to start with! Start there and work your way down. It really is sad that someone can be so stupid, yet not able to accept responsibility for their own mistakes! Yes, all of our insurance rates are higher because of this crap!
