In filings to the U.S. district court in Delaware, Deere alleged that products made or sold by Precision Planting, including vSet seed meters along with SpeedTube products, infringed on its patents.
The company also said the patents protected its inventions that facilitate accurate seed placement, uniform seed spacing and even crop emergence. Deere has suffered damages as a result of the direct and indirect infringing activities of Defendant and will continue to suffer such damages as long as those infringing activities continue,” the company said in the lawsuit. According to the lawsuit, the company is seeking unspecified damages. AGCO acquired Precision Planting in September 2017. |

Reminds me of this story of Kinze, Deere tried suing him for patent infringement on their row units when they fraudulently filed every patent. http://www.farm-equipment.com/articles/12094-the-rear-fold-planter-and-the-battle-that-ensued

Funny, Deere was gonna buy PP til the justice dept. said NO. That made John Deere's undies extra tight and now they gonna sue. They're like a bunch of immature brats with BILLIONS of dollars to sue when they don't get their way. Good grief!

I agree, you say most failed but I think every full line American farm equipment maker has failed except Deere.

That is a fascinating article. I will have to get the book. As an attorney, I found it particularly interesting and reflective of some things I have experienced in trying cases (though a completely different area of the law). The attorney for Kinze had....I'll just say brass in recommending to copy the row units. However, he backed up his bold advice in court. Spectacular! That being said, I have no idea about the merits of the current suit. I GUARANTEE that Deere and its counsel learned a great deal from the Kinze suit...assuming any of them remember it. Heck, I was in elementary school when that suit was tried and I've been practicing law for 20 years, now, so who knows?

Wow. That is an awesome story. That is the reason for patent and antitrust laws. Well done.

If you ever get the chance to get to Williamsburg Iowa and visit there manufacturing plant and museum, it is well worth it. Better yet work out a deal were you can visit Kinze's private collection. He has tractors hanging from the ceiling. Also his engineering is amazing.
He also made a JD 730 the way John Deere should have. He moved the 2cyl over and welded another 2 cyl 180 degrees out of faze. Making it a 4 cyl. It starts and sounds like a normal tractor. |
